Sujit Choudhry Constitutional Design Specialist and International Consultant

Sujit Choudhry is internationally known and respected for his professional contribution to the field of constitutional law and political science. He has been involved in this spectrum of discourse as a writer, academician and consultant for over two decades.  In addition to holding a professorship at the University of California Law School, Berkeley; Mr. Choudhry also is consultant to the World Bank, and member of the UN Mediation Roster. Mr. Choudhry’s capacity and understanding of comparative constitutional design is rather diverse. He is well informed on constitutional design in pluralistic societies, constitutional design in relation to group rights, federalism and more.

A New Chapter to his Upcoming Book.

Sujit Choudhry’s recent effort is a book chapter that in part is a response to a tweet by the former US Attorney General, Eric Holder. This tweet by Holder was a call-to-action and composed in late 2017. The tweet calls for public, peaceful mass demonstration by Americans should either primary investigator Bob Mueller be fired, or the Special Council Office be severely limited in its function to investigate charges of Russian interference in the 2016 US elections. Holder, according to Choudhry’s essay, questions the value of constitutional democracy in suggesting the idea of an invisible red line if Mueller is fired or the council inhibited (  Also, Constitutional democracy is devalued by Holder in asserting the American public would collectively decide the rightness or wrongness of public official sin and or iniquity.

Internationally, a trend called democratic backsliding occurs when some world powers have the veneer of democracy, but underneath courts or government structures show otherwise on examination. In Poland, for example, an ongoing struggle between the Law and Justice Party and the government is occurring so that the government can ensure its appearance on the ballot in future elections. Choudhry indicates a move though subtle in the USA towards the relaxation of term limits initiated by elected officials. This too is an effort to devalue constitutional democracy.
